These Terms & Conditions (“Terms”) govern your use of POAS.ae and the services provided through it. By accessing POAS.ae or placing an order, you agree to these Terms. POAS.ae is operated by CENDALE DOCUMENTS CLEARING SERVICES FZCO (“Operator”, “we”, “us”, “our”), a company incorporated in the United Arab Emirates. POAS.ae is a private service provider and is not affiliated with any government authority, court or registration body.
1. Definitions
- “POAS.ae” / “Platform” means the website and any associated pages, forms, portals and communication channels used to deliver the service.
- “Client” / “you” means the individual or entity requesting services through POAS.ae.
- “Service” means the preparation of a tailored Power of Attorney document and coordination of its notarisation through an independent private notary licensed by Dubai Courts, within the ten POA services listed on the homepage.
- “Third Parties” means the independent Dubai Courts private notary, translation providers, banks, developers, trustees, registries and any receiving institution that may impose acceptance requirements.
2. Nature of the service
POAS.ae prepares tailored Power of Attorney documents in Arabic and English and coordinates notarisation with an independent private notary licensed by Dubai Courts. Unless expressly stated otherwise in writing:
- POAS.ae is not a government department, court, public or private notary, or law firm, and does not represent any authority;
- POAS.ae does not give legal, tax, financial, immigration, litigation or succession advice;
- POAS.ae does not issue official approvals, stamps or attestations; where official actions are required, these are performed by the relevant competent authorities and licensed professionals;
- POAS.ae provides only the ten POA services listed on the homepage and does not take on POA work outside that list.
3. Eligibility and authority to act
- You must be 18 years of age or older to use this website or transact through it; minors may not register, submit instructions or make payments.
- If you act on behalf of a company or another person, you confirm you have authority to do so.
- We do not trade with, or provide services to, individuals or entities located in OFAC-sanctioned or restricted jurisdictions, and may refuse service where compliance requirements are not met.
4. Orders, scope and instructions
Payment is made in advance. The scope of each order is defined by the service description on POAS.ae and any written confirmation we provide for your request. You are responsible for ensuring your instructions are accurate and complete, including the correct spelling of names, passport/Emirates ID details, the powers requested, and any wording, form, attendance or KYC requirement already communicated to you by the receiving party. We confirm the correct POA type after payment and before drafting.
5. Fees, payments and taxes
- The price shown is the POAS service fee. VAT is shown separately.
- Private-notary, government, translation, courier, bank and other third-party charges are separate unless checkout expressly states otherwise; variable charges are confirmed before submission.
- All prices are displayed in AED unless specified otherwise. The price and currency shown at checkout are the price and currency printed on the transaction receipt; the amount charged is reflected in the cardholder’s billing currency at the card issuer’s exchange rate.
- Please retain your transaction records together with these Terms and the related policies.
6. Payment confirmation
Once payment is completed, a confirmation is issued to the contact details provided at checkout, by email and WhatsApp, within 24 hours of receipt of payment. If you do not receive it within that time, contact our support team.
7. Cancellations and refunds
Cancellations and refunds are governed by our Refund Policy, including the POA Fit Promise: if a POA we prepared does not work for the purpose agreed in your order because of a POAS scope or drafting error, we correct it without another POAS service fee, or refund the POAS service fee if we cannot. Third-party fees and third-party decisions are excluded as set out in the Refund Policy. Where these Terms and the Refund Policy differ on refunds, the Refund Policy governs.
8. Third-party dependence and acceptance
Many POA workflows depend on third parties and their rules. Appointment availability, notarisation decisions and a receiving party’s acceptance are outside our control. A bank, developer, registry, authority or other recipient may reject or add requirements for reasons unrelated to our work. We coordinate actively and reduce avoidable errors, but we do not guarantee acceptance by any third party.
9. Communication channels
You may communicate with us via secure portal upload, email, WhatsApp or phone. WhatsApp and email are third-party platforms not controlled by us; for maximum confidentiality, use the secure portal upload route where available.
10. Confidentiality and data handling
We treat client information as confidential and handle documents on a need-to-know basis. Our commitments on information handling are described in our Privacy Policy. Where these Terms and the Privacy Policy conflict on data handling, the Privacy Policy governs.
11. Prohibited use
You agree not to provide false or misleading documents or instructions, use the service for unlawful purposes, attempt to compromise the platform’s security, or harass staff or third parties involved in execution. We may refuse service or terminate active handling where misuse, fraud risk or abusive conduct is identified.
12. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental or consequential losses, or for third-party decisions, refusals, policy changes or delays. Our total liability for any claim relating to the service is limited to the POAS service fees paid for the specific order giving rise to the claim (excluding third-party fees), unless a higher liability is required by law.
13. Service availability
We aim to keep the platform available and reliable, but downtime or interruptions may occur due to maintenance, third-party outages or unforeseen events. We do not guarantee uninterrupted availability.
14. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates. Any disputes are subject to the competent UAE courts, unless otherwise required by applicable law.
15. Amendments
We may update these Terms from time to time to reflect operational, legal or regulatory changes. The updated version takes effect once published on this page. Continued use of the website constitutes acceptance of the updated Terms.
